CETA

El Acuerdo Económico y Comercial Global (o CETA por sus siglas en inglés) pactado en 2014 entre la Unión Europea y Canadá, entró en vigor provisionalmente en septiembre de 2017.

El acuerdo cubre casi todos los aspectos de los arreglos de comercio de nueva generación, incluyendo propiedad intelectual, adquisiciones públicas, cooperación regulatoria, servicios y eliminación de aranceles.

Incluye también un capítulo de inversiones con un mecanismo revisado de arbitraje de disputas entre inversionistas y Estados (ISDS), denominado sistema de arbitraje de inversiones. Sin embargo, muchas críticas de ambos lados del Atlántico expresan que este nuevo sistema constituye en gran medida una artimaña para tratar de mejorar las apariencias y que no aborda la base del problema detrás de las medidas de controversias entre el estado y el inversor que permite que las corporaciones extranjeras demanden jurídicamente a los Estados, si consideran que su potencial de ganancias o de inversión se ve afectado por nuevas leyes o cambios en políticas publicas.
